Alimony Pendente Lite (Temporary Alimony):

Spousal support and Alimony Pendente Lite are temporary forms of support payments made during the separation period of spouses before a divorce has been finalized. There is virtually no defense to a claim for Alimony Pendente Lite, and a party otherwise not entitled to spousal support may be entitled to Alimony Pendente Lite once the divorce action is filed. There is no entitlement defense as in Spousal Support.

Both Spousal Support and APL are calculated in the same way. The support is 40% of the difference between the payor’s net monthly income and the recipient’s net monthly income, if there are no minor children. If there are minor children, then the income differential is reduced by the amount of the child support, and the result is multiplied by 30%.

In general, the support award is added to the child support award into an unallocated support order. The payment is taxable to the recipient and a deduction for the payor.

Many people do not understand the complexities of a divorce until they go through one. Everyone, however, is concerned about his or her future, happiness, and well-being, and even more so that of the children. Our law firm can represent you, and we will work to get you the temporary financial support you may need and deserve, until such time as your divorce is finalized. Spousal Support or APL (Alimony Pendente Lite) may be appropriate to equalize the parties’ ability to afford effective representation and otherwise to “level the field of play,” so to speak. It would be unfair for a spouse who may have advanced in his or career and attained a high income to use that advantage to retain the best of legal teams and live comfortably, while the other spouse, who may have raised the children and/or made other significant contributions to the marriage and the family is left without resource to live comfortably and also hire effective legal representation. Our legal team will work to get you the equality and security you should have.
