ARBITRATION AND MEDIATION

After suffering an injustice or encountering a dispute which seems unresolvable, many individuals and businesses immediately turn to thoughts of lawsuits and court trials. Often, however, it is possible to reach a satisfactory resolution without litigation or trial by using the services of a trained mediator or arbitrator through a process commonly referred to as alternative dispute resolution (ADR).

In mediation, both parties may be represented by their own attorneys, and both agree to use our trained attorney as an unbiased mediator in a confidential forum.  As mediators, we carefully listen to the positions of the parties and assist them in reaching an amicable resolution to the dispute.  Mediation can be used by the parties before a lawsuit is filed or at any time after litigation has commenced.

In arbitration, our experienced attorneys act as the decision-maker—either alone or as part of a panel of arbitrators—considering the arguments and evidence presented by both sides and making a decision based on the facts of the case. This decision is often binding on the parties.
